Terms & Conditions of sale and use
1. Identification of the seller

These Terms and Conditions govern the use of the online store available at www.avicennabeauty.com (the “Store”) and the purchase of Products offered therein.

2. Definitions
For the purposes of these Terms:
- Customer – any natural or legal person/company placing an order via the Store
- Consumer – a Customer acting outside their trade, business, craft or profession
- Products – physical goods offered for sale
- Digital Content – data produced and supplied in digital form
- Order – a declaration of intent to purchase Products
- Contract – a sales or service agreement concluded between the Customer and the Seller
- Carrier – a third-party logistics provider
- Business Days – Monday to Friday, excluding public holidays
3. Scope and acceptance
- These Terms constitute a legally binding agreement between the Customer and the Seller.
- By placing an Order, the Customer confirms that they have read, understood, and accepted these Terms.
- If the Customer does not agree, they must refrain from using the Store.
- These Terms apply to all sales unless otherwise agreed in writing.
4. Use of the store
- The Store is accessible 24 hours a day, subject to maintenance or technical interruptions.
- The Customer is responsible for:
- ensuring compatibility of their device
- maintaining confidentiality of login credentials
- The Customer shall not:
- use the Store unlawfully
- interfere with its operation
- attempt unauthorized access
5. Account registration
- The Customer may create an account for enhanced functionality.
- Registration is voluntary and free of charge.
- The Customer guarantees that all data provided is accurate and up to date.
- The Seller reserves the right to suspend accounts in case of misuse.
6. Order process and contract formation
- Product listings do not constitute a binding offer but an invitation to treat.
- An Order is placed by selecting Products and confirming purchase via the “Buy & Pay” button.
- The Contract is concluded upon confirmation by the Seller via email.
- The Seller reserves the right to:
- refuse an Order
- partially accept an Order
- propose modifications
7. Prices and taxes
- Prices are displayed in EUR or USD and include applicable VAT unless stated otherwise.
- Shipping costs and additional fees are calculated separately.
- The total price is shown prior to Order confirmation and is binding.
8. Payment methods
The Seller provides the following payment options:
- online payments via PayPro S.A.
- credit and debit card payments
- bank transfer
- cash on delivery (where available)
Additionally:
- the Seller may offer checkout via InPost Pay
- available methods depend on the Customer’s location
- Payments must be made within 3 Business Days unless otherwise stated.
- Failure to complete payment may result in cancellation of the Order.
9. Delivery
- Delivery is performed via third-party Carriers.
- Delivery times vary depending on the destination and are estimates only and not guaranteed.
- Risk of loss or damage transfers to the Customer upon delivery.
- The Customer should inspect the parcel upon receipt and report damage immediately.
- The Customer may be responsible for customs duties, taxes, or import charges imposed by the destination country.
10. Digital content
- Digital Content is delivered electronically after payment.
- By purchasing Digital Content, the Customer:
- consents to immediate delivery
- acknowledges loss of withdrawal rights where applicable
- The Customer is responsible for ensuring technical compatibility.
- The Seller is not responsible for failure to access digital content due to incorrect email address provided by the Customer.
11. Right of withdrawal
- If the Customer is a Consumer, they have the right to withdraw from the Contract within 14 (fourteen) days without providing any reason.
- The withdrawal period expires 14 days after the day on which the Customer acquires physical possession of the Products.
- To exercise the right of withdrawal, the Customer shall inform the Seller of their decision by means of a clear statement sent to:
- In the event of withdrawal, the Contract shall be deemed not concluded.
- The Seller shall reimburse all payments received from the Customer, excluding return shipping costs, without undue delay and no later than within 14 days.
- The Seller may withhold reimbursement until the Products are received or proof of return is provided.
12. Conditions for return
Returned Products must:
- be unused and unopened
- be in original packaging
- be in a condition allowing resale
The Seller reserves the right to refuse returns that do not meet these conditions.
13. Non-Returnable Products
The following products are not eligible for return:
- essential oils and aromatherapy products once opened
- any product with a broken seal
- products exposed to air, light, or contamination
- digital products (after access/download)
Essential oils and similar products are classified as hygiene-sensitive goods, as their chemical composition may change upon exposure to air and use, and their packaging cannot be effectively resealed to guarantee safety and quality. Therefore, such products cannot be returned once opened.
14. Return Procedure
To request a return:

15. Return Shipping
- The Customer bears the direct cost of returning the Products.
- The Seller recommends using a trackable shipping method.
- The Seller is not responsible for returns lost in transit.
16. Refunds
- Refunds will be issued within 14 days from receipt of the returned Product or proof of return.
- Refunds will be made using the original payment method unless otherwise agreed.
- Original shipping costs are non-refundable
17. Damaged or Incorrect Products
- If the Customer receives a damaged or incorrect Product, they should notify the Seller as soon as reasonably possible, preferably within 48 hours.
- The notification should include photographic evidence.
- The Seller will, at its discretion:
- replace the Product, or
- issue a refund
18. Digital Products
- Digital Products are delivered immediately after purchase.
- By purchasing Digital Products, the Customer:
- expressly consents to immediate performance
- acknowledges loss of the right of withdrawal
19. Order Cancellation
1. Orders may be cancelled before dispatch. After dispatch, the return procedure applies.
20. Complaints and liability
- The Seller is liable for lack of conformity of Products in accordance with applicable law.
- To the maximum extent permitted by law, the Seller’s liability shall be limited to the value of the Order.
- Complaints may be submitted via email:
- The Seller will respond within 14 days.
- The Seller shall not be liable for:
- indirect damages
- interruptions caused by third parties
- force majeure events
- For non-consumer Customers, liability may be limited to the extent permitted by law.
21. Data protection
- Personal data is processed in accordance with GDPR (EU Regulation 2016/679).
- Data is used for:
- order fulfillment
- account management
- legal obligations
- marketing (with consent)

22. Intellectual property
All content of the Store, including trademarks, texts, graphics, and software, is the property of the Seller and is protected by intellectual property laws.
Unauthorized use is strictly prohibited.
23. Governing law and disputes
- These Terms shall be governed by the laws of Poland.
- Consumers may also rely on mandatory provisions of their country of residence.
- Disputes may be resolved via the EU Online Dispute Resolution platform.
24. Final provisions
- The Seller reserves the right to amend these Terms at any time.
- Amendments shall not affect Orders already placed.
- The latest version is always available on the Store website.
